Despite Rule allowing only one dog per unit, the Respondents were entitled to an accommodation permitting two dogs.
The Condominium Authority Tribunal held that – despite the Corporation’s Rule permitting only one dog per unit – the residents were entitled to an accommodation permitting two dogs. The Tribunal had allowed the accommodation, awarded damages, and ordered a small credit on common expenses. [See Condo Cases Across Canada, Part 87, September 2024.]
The condominium corporation appealed the Tribunal’s decision. The appeal was dismissed by the Divisional Court.
