Requested insurance denial letter (and related reports) were not part of Corporation’s records

The owner requested an insurance denial letter (and related reports) in connection with a water escape incident, which the owner alleged had caused damage to her unit.

 

The Tribunal found that the corporation had a reasonable excuse for not providing the requested record, as the record did not exist and the corporation could not produce documents outside its custody or control.
