Tribunal denies claim for compensation in relation to lost tenant
The owner’s claim for compensation related to a tenant’s departure was denied. While a neighbor was found to have caused unreasonable noise, the owner failed to prove that this noise was the exclusive reason for the tenant’s termination of the lease.
Furthermore, the Tribunal concluded that the condominium corporation’s enforcement efforts were reasonable. The Tribunal said:
Based on the evidence before me, I find that the Respondent, Anh Tu Mai was responsible for the unreasonable noise that caused disruption to Mr. Shaddad’s tenant. In these circumstances, TSCC 2543 has demonstrated that they took appropriate steps to intervene, and escalated their interventions, to manage that unreasonable noise. As the evidence before me does not support Mr. Shaddad’s timeline, I am unable to find in favour of the Applicant’s request that his realtor fees be compensated by either Respondent.
