Corporation had not failed to reasonably enforce its parking rules
The Tribunal dismissed an owner’s application alleging the corporation failed to enforce parking rules. While unauthorized parking occurred, the Tribunal held that condominium boards only need to take reasonable steps to enforce rules and enjoy discretion (about how to fulfill such obligations) under the business judgment rule. The corporation was ordered only to issue a reminder notice to owners containing information about its parking rules and enforcement activities.
