Tribunal dismisses claims against former President, for alleged obstruction of strata council activities
The Strata Corporation sought a declaration that its council had been validly elected, as well as an order requiring the former president, Mr. Harlton, to stop obstructing council activities and to return keys and documents.
The Tribunal dismissed the claims, holding that the Tribunal lacked authority to make declaratory orders, and that the issue of the 2023 council’s validity was in any event moot given subsequent elections. The Tribunal also found that the other requested orders were either too vague to enforce or unsupported by evidence, as the corporation had not proven that Mr. Harlton still held keys or documents.
