Owner not responsible for damaged screen

The owner challenged a $200 fine and responsibility for a damaged patio door screen. The strata corporation had alleged that she was responsible for a rodent infestation, claiming that her unit was messy, and that her screen door had been chewed because she had left her main door open.

 

The Tribunal found that the building had pre-existing pest issues and that the owner had kept her unit clean and used sealed containers.  It also was not improper for her to open her main door.  Because the screen was attached to the building’s exterior, it was ruled common property, making the corporation legally responsible for its replacement.
