Tribunal removes fine and chargeback against former Council President

The former strata council president challenged a $200 fine and a $598.13 chargeback imposed after he removed a plant from a common planter for security reasons. The Tribunal ruled in his favor, finding that he acted in his official capacity and was protected by by-laws that indemnified council members from personal liability unless they acted in bad faith.

 

While his fine was cancelled, the Applicant’s claims for harassment and mental distress were dismissed because he lacked the necessary medical evidence.
